Formula F.I.T.T., LLC – Checkout Terms of Service Agreement & Waiver

By completing this purchase, you acknowledge that you have read, understood, and agree to the terms outlined below.

By using this website, purchasing any product or service, or participating in any offering by Formula F.I.T.T., LLC and/or Coach Eve Webber (“Company,” “we,” “us,” or “our”), you (“user,” “you,” or “client”) agree to be legally bound by the following Terms of Service and Waiver. Please read them carefully before proceeding.

  1. Scope of Services

We provide general education and support in the areas of:
Functional health, hormone and gut health guidance
Fitness training and injury prevention
Fire and police department wellness consulting
Lab interpretation guidance and wellness plans
Mental health support education, stress management, and peer support
Online content via blog, podcast, email, downloads, and community discussions

We do not diagnose, treat, or cure any condition. All services are for educational purposes only.

  1. Career Services Disclaimer (Firefighter Interview & Resume Services)

Any firefighter interview preparation, mock interviews, resume audits, interview question banks, coaching, or related materials are provided for educational and preparatory purposes only. These services are designed to simulate common interview formats and provide general feedback based on experience and best practices. They do not constitute a real hiring interview, official examination, or formal evaluation by any fire department, agency, or governing body.

Formula F.I.T.T., LLC and Coach Eve Webber do not guarantee employment, job placement, interview advancement, conditional offers, or hiring outcomes. All hiring decisions are made solely by individual fire departments or agencies and are influenced by factors beyond our control.

By purchasing or participating in these services, you acknowledge and agree that results vary, and no specific outcome, employment result, or hiring decision is promised or implied.

  1. Independent Evaluators Disclaimer

Mock interviews and interview feedback may be conducted by independent interview evaluation experts who are contracted separately by Formula F.I.T.T., LLC. These individuals are not employees, agents, or representatives of the Company and do not have authority to make hiring decisions, employment recommendations, or representations on behalf of any fire department or agency.

  1. Medical Disclaimer

We are not medical doctors, licensed therapists, registered dietitians, or physical therapists. Our content and services are non-clinical.

Any assessments, recommendations, or strategies presented are non-diagnostic and for general wellness education only.

You are solely responsible for seeking guidance from a qualified healthcare provider before beginning any new program, training plan, or lifestyle recommendation.

You are responsible for consulting your healthcare provider before implementing any information, advice, or product from our platforms.

Do not stop any medication or treatment without medical supervision. Participation in any program is at your own discretion and risk.

  1. Assumption of Risk and Waiver of Liability

By participating in our services, you confirm that you are voluntarily assuming all physical, emotional, and mental risks.

You release Formula F.I.T.T., LLC, Coach Eve Webber, Evelyn Webber, and all contractors, partners, and affiliates from any and all liability for injuries, damages, losses, or illnesses that occur directly or indirectly from your participation.

This applies whether you are a private client or a member of a fire or police department wellness initiative.

  1. Intellectual Property Rights

All materials, including videos, workouts, guides, downloads, blogs, podcasts, and visuals, are protected intellectual property.

You may not copy, reproduce, modify, share, or distribute any content without prior written consent.

Limited personal use is permitted. Commercial use or sharing is prohibited unless authorized in writing.

  1. Payment, Refunds, and Subscriptions

All payments are final and non-refundable after twenty-four (24) hours, except as outlined below.

Online programs, digital products, and virtual coaching services are non-refundable once accessed due to the immediate delivery of content and protection of intellectual property.

Discounted or promotional items are final sale and are not eligible for refunds under any circumstances.

In-person services may be eligible for a refund within twenty-four (24) hours of purchase provided no sessions have been used.

Refunds will be considered only in documented emergency situations, including hospitalization, military deployment, or death of an immediate family member. Documentation must be provided. Any approved refund will exclude services already delivered.

Subscription-based coaching programs auto-renew monthly unless canceled at least thirty (30) days in advance via written notice. No prorated refunds are provided.

By purchasing, you acknowledge immediate access to digital content and waive any statutory or implied refund rights applicable to digital goods once access is granted.

Refund requests based on dissatisfaction, scheduling conflicts, technical issues on the user’s end, or change of preference will not be honored.

Initiating a credit card dispute or chargeback after agreeing to these terms constitutes a breach of this agreement and may result in administrative fees, termination of access, and removal from all services and platforms.

  1. Refund and Cancellation Policy (Supplemental)

Mock Interview Services: Refunds are available only if requested at least twenty-four (24) hours prior to the scheduled interview. No refunds will be issued for interviews that have already occurred.

Late Cancellation or No Show: Cancellations made less than twenty-four (24) hours before the scheduled interview are not refundable. Rescheduling may be permitted at the discretion of Formula F.I.T.T., LLC.

Resume Audit Services: Refunds are available only if requested before the audit occurs. Once feedback has been provided, the service is considered complete and non-refundable.

Nutrition Audit Services: Refunds are available only if requested before the scheduled audit. Once verbal or written feedback has been provided, no refunds are available.

Firefighter Interview Question Bank: Due to the digital nature of this product, all sales are final once delivered.

Package Policies: Refunds are prorated based on services not yet delivered. Once any component of a package has been delivered, that portion is non-refundable.

  1. Session Expiry and Rescheduling

Packages expire six (6) months from the date of purchase unless otherwise specified.

Twenty-four (24) hours’ notice is required to reschedule sessions.

Late arrivals of fifteen (15) minutes or more may result in forfeiture of the session.

Illness-related rescheduling must occur within four (4) weeks to remain valid.

  1. Department and Organizational Consulting

For fire and police agencies, we provide educational consulting services including wellness program development, peer support planning, non-clinical health guidance, and stress management education. We do not provide medical treatment or replace departmental medical personnel.

  1. Podcast, Blog, and Community Access

All podcast, blog, and community content is informational only. Donations, subscriptions, or community access do not create a professional-client relationship. Use of this content is at your own risk.

  1. Technology and Third-Party Platforms

We utilize third-party platforms including Kajabi, Stripe, PayPal, Train Heroic, Google Meet, Zoom, and affiliate providers. We are not responsible for outages, data practices, or issues associated with third-party platforms.

  1. Affiliate Disclosure

Some links or recommendations may generate commissions at no additional cost to you. We only recommend products we trust and use ourselves.

  1. International Users

Our services are based in the United States and governed by U.S. law. International users are responsible for compliance with local laws.

  1. Age Requirement

You must be at least eighteen (18) years old to purchase or participate in services.

  1. User Conduct

You agree not to misuse the website, misrepresent yourself, infringe intellectual property, distribute malicious software, or use content for illegal purposes.

  1. Termination of Access

We reserve the right to restrict or terminate access to services if these terms are violated.

  1. Governing Law, Venue, and Class Action Waiver

These Terms are governed by the laws of the State of California.

All disputes shall be resolved exclusively in the state or federal courts located in Placer County, California.

You waive the right to participate in any class action, collective action, or representative proceeding.

  1. Entire Agreement

These Terms constitute the entire agreement between you and the Company. Failure to enforce any provision does not waive future enforcement.

By checking the box at checkout and completing your purchase, you affirm that you have read, understand, and agree to these Terms, that you participate voluntarily and at your own risk, and that your purchase includes immediate access to content.
