By using this website, purchasing any product or service, or participating in any offering by Formula F.I.T.T., LLC and/or Coach Eve Webber (“Company,” “we,” “us,” or “our”), you (“user,” “you,” or “client”) agree to be legally bound by the following Terms of Service and Waiver. Please read them carefully before proceeding.

4. Fire and police department wellness consulting
5. Lab interpretation guidance and wellness plans
6. Mental health support education, stress management, and peer support
7. Online content via blog, podcast, email, downloads, and community discussions

We do not diagnose, treat, or cure any condition. All services are for educational purposes only.

2. Medical Disclaimer

We are not medical doctors, licensed therapists, registered dietitians, or physical therapists. Our content and services are non-clinical.

Any assessments, recommendations, or strategies presented are non-diagnostic and for general wellness education only.

You are solely responsible for seeking guidance from a qualified healthcare provider before beginning any new program, training plan, or lifestyle recommendation.
You are responsible for consulting your healthcare provider before implementing any information, advice, or product from our platforms.

Do not stop any medication or treatment without medical supervision. Participation in any program is at your own discretion and risk.

3. Assumption of Risk and Waiver of Liability

By participating in our services, you confirm that:

1. You are voluntarily assuming all physical, emotional, and mental risks.
2. You release Formula F.I.T.T., LLC, Coach Eve Webber, Evelyn Webber, and all contractors, partners, and affiliates from any and all liability for injuries, damages, losses, or illnesses that occur directly or indirectly from your participation.

This applies whether you are a private client or a member of a fire/police department wellness initiative.

4. Intellectual Property Rights

All materials, including videos, workouts, guides, downloads, blogs, podcasts, and visuals, are protected intellectual property.
You may not copy, reproduce, modify, share, or distribute any content without prior written consent.

Limited personal use is permitted; commercial use or sharing is prohibited unless authorized in writing.

5. Payment, Refunds & Subscriptions

1. All payments are final and non-refundable after 48 hours, except as outlined below.
2. Online programs, digital products, and virtual coaching services are strictly non-refundable once accessed, due to the immediate delivery of content and protection of intellectual property.
3. Discounted or promotional items are FINAL SALE and are not eligible for refunds under any circumstances.
4. In-person services (such as live coaching or personal training) may be eligible for a refund within 48 hours of purchase only if no sessions have been used.
5. Refunds may be considered only in documented emergency situations (e.g., hospitalization, military deployment, or death of an immediate family member). Proof must be provided, and any refund granted will be at the sole discretion of Formula F.I.T.T., LLC.
6. Subscription-based coaching programs auto-renew monthly unless canceled at least 30 days in advance via written notice. No prorated refunds are given for unused time.
7. By purchasing, you agree that you have immediate access to digital content, and that viewing, downloading, or accessing this content constitutes full use of the service.
8. Refund requests based on dissatisfaction, scheduling conflicts, technical issues on your end, or a change of preference will not be honored.

• Initiating a credit card dispute (“chargeback”) after agreeing to these terms may result in legal action, administrative fees, and immediate removal from all services and platforms.

• Session Expiry & Rescheduling (If Applicable)

1. Packages expire six (6) months from the date of purchase unless otherwise specified.
2. 24-hour notice is required to reschedule a session to avoid forfeiture.
3. Late arrivals of 15+ minutes may result in a forfeited session.
4. If illness occurs, sessions must be rescheduled within four (4) weeks to remain valid.

• Travel Fees & Shared Sessions (If Applicable)

1. Travel fees apply for locations over 20 miles and are included in pricing unless noted otherwise.
2. For buddy/shared sessions, all participants must attend or the session will count as used unless rescheduled in advance.

6. Department & Organizational Consulting

For fire and police agencies, we provide:

1. Custom wellness program development
2. Peer support system planning
3. Non-clinical health guidance (e.g., lab recommendations, cancer screening education)
4. Mental resilience education, injury prevention and stress reduction strategies

We do not replace departmental medical personnel or offer treatment. We support organizational goals through educational tools only.

7. Podcast, Blog, and Donation Access

All podcast and blog content is informational only.
Support via donations, subscription access, or Kajabi community involvement does not create a professional-client relationship.
Use of this content is at your own risk.

8. Technology, Platform & Tools Disclosure

We utilize third-party platforms like:

1. Kajabi (courses, websites, payments)
2. Stripe or PayPal (payment processing)
3. Train Heroic (training programs)
4. Google Meet / Zoom (video sessions)
5. Affiliate and supplement links via third-party providers

We are not responsible for the data practices, outages, or issues from these external platforms. Users are encouraged to review their respective Terms of Use and Privacy Policies.

9. Affiliate Disclosure

Some links or recommendations may be affiliate partnerships.
This means we may earn a small commission—at no cost to you—if you purchase through those links.
However, we only recommend products we trust and use ourselves. These relationships do not influence our content integrity.

10. International Users

Our services are based in the United States and governed by U.S. law.
If you access this site or purchase services from outside the U.S., you do so at your own risk and are responsible for compliance with your local laws.

11. Age Restriction

14. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the State of California, and any disputes shall be resolved exclusively in a California court or through agreed-upon arbitration.

By purchasing, you agree that any disputes will be resolved exclusively in the jurisdiction of Placer County, California, regardless of your location at time of purchase.

You waive the right to initiate claims outside of California or as part of any class-action suit.

These Terms constitute the entire agreement between you and the Company.
